Justice James Omotosho of the Federal High Court in Abuja on Thursday listed four issues that will determine the judgment in the trial of Nnamdi Kanu, the incarcerated leader of the Indigenous People of Biafra, IPOB.
The judge noted that the defendant had challenged the jurisdiction of the court.
Recall that Kanu had insisted that judgment would not be delivered in the terrorism charge the Federal Government filed against him.
However, the judge ordered security agents to escort the detained IPOB leader, Nnamdi Kanu, out of the courtroom.
The judge said: “The court formulates these issues:
One, whether the defendant was denied his right to a fair hearing in the circumstances of this case.
“Two, whether the claim of extraordinary rendition of the defendant from Kenya invalidates the trial in this case.
“Three, whether the provisions under which the defendant is being tried are repealed laws and therefore inoperative.
“Four, whether the prosecution has established the charge against the defendant beyond reasonable doubt.”
