Ephraim Akpata Arbitrated Few Domestic Arbitrations with An International Flavour
History of Nigerian Arbitration Law in Focus
At the time of publishing the first edition of the book, “The Nigerian Arbitration Law in Focus,” its author, the late Hon. Justice Ephraim Omorose Ibukun Akpata, had retired as a Justice of the Supreme Court of Nigeria and was a Consultant in the legal firm of Babalakin & Co.
He had arbitrated a few domestic arbitrations with an international flavour at the time and considered himself an author in the category of “… the non-experts who perhaps know little or nothing at the onset about the topic of the book they intend to write but are driven to write by a desire to fill a vacuum or for other reasons and, therefore, had to do some research to be able to produce their work.”
The book is an insight into the Arbitration and Conciliation Act 1988 (Cap A18, Laws of the Federation of Nigeria 2004). The objective of the book, as stated by Justice Akpata, was “… to bring about easy understanding of every section of the Act and the related rules contained in its First, Second and Third Schedules. It is meant to be a handbook and to serve as a vade mecum for quick reference by arbitrators and counsel in arbitral proceedings and for the enlightenment of those who may, when a dispute has arisen in any commercial transaction they are involved in, contemplate going to arbitration.”
The authors of the second edition to “The Nigerian Arbitration Law in Focus”, Mrs. Obosa Akpata and Mrs. Olusola Adegbonmire are practicing lawyers and Chartered Arbitrators who are on the faculty of the Chartered Institute of Arbitrators and serve on the Executive Committee of the Nigerian Branch. The authors are also Accredited Mediators of the Centre for Effective Dispute Resolution (CEDR).
The authors state that they each found the first edition useful in their training as arbitrators and subsequently in the course of their respective practices as arbitrators. In addition, the first edition, though published over 22 years ago, has remained relevant till this very day. Since its publication however, a lot has happened in the Nigerian Arbitration scene – a situation that has led to a desire to revise the first edition of “The Nigerian Arbitration Law in Focus”.
In coming up with the second edition, the authors have tried to be faithful to the intention of the late Hon. Justice Ephraim Akpata “to bring about an easy understanding of the Act.”
It is their sincere hope that this purpose has been achieved.
