The Federal High Court in Abuja has scheduled April 16, 2024 for the definite hearing of a suit filed by human rights activist Maxwell Opara, challenging the appointment of Mrs. Adepoju Caroline Wura-Ola as the Comptroller General of the Nigeria Immigration Service (NIS) after her due age of retirement by President Bola Ahmed Tinubu
Opara, through his counsel, filed the suit in January 2024, asking the court to nullify Wura-Ola’s appointment over allegations that it violated the provisions of the Immigration Act 2015. According to the case filed, the appointment did not follow established laws which state that the Comptroller General should be appointed from amongst serving Deputy Comptrollers General of Immigration
Wura-Ola was appointed in December 2023 by President Tinubu to replace the former NIS Comptroller General Muhammed Babandede, who retired from service. Opara contends that by appointing someone from outside the top ranks of the NIS, the president flouted Nigeria’s immigration laws.
The civil rights activist is therefore asking the court to void Wura-Ola’s appointment and direct all parties involved to follow the stipulated provisions of the law in selecting a replacement.
On Monday, Justice Adamu Hobon of the Federal High Court, Abuja agreed to a definite hearing date and asked all parties involved to ensure they file and exchange necessary court processes well ahead of the April 16 court session.
