Badeggi Radio out-of-court settlement suffers setback

The proposed out-of-court settlement in the closure of Badeggi Radio by the Niger State Government has suffered a setback, as the government has refused to settle out of court.

Recall that in case number NSHC/M/0296/2025, the state government counsel, Jacob Usman SAN, had on the August 25 2025, informed the presiding judge, Justice Mohammed Mohammed that there was a move for an out-of-court settlement.

He told the plaintiff’s counsel during the last hearing, “I have had a discussion with my clients the governor of Niger State and Attorney General of the Niger State, that we need to resolve the matter and he agreed.

“And the counsel to the plaintiffs also agreed that the matter be resolved in the best interest of his clients. And we Informed the court as such,” Usman said.

At the resumed hearing to report back to the court on the out-of-court settlement, earlier slated for Wednesday, 3 September 2025, counsel to Badeggi Radio, Philip Emmanuel, told the court that the settlement had failed.

“My lord. It is unfortunate that the out of court settlement as requested in the last sitting by the state government has failed,” Emmanuel told the court.

Corroborating the position of the counsel to the plaintiff, counsel to the Niger State Government also told the court that the out-of-court settlement had failed, adding that they were still exploring another means of resolving the matter outside court.

However, the presiding judge, Justice Mohammed, held that if the settlement had failed, the case file would now be transferred to the Chief Judge to reassign it.

“As you know, I’m a vacation judge. The vacation will resume by next week. I will now be on vacation, the chief judge will either re-assign the case as the case maybe,” Justice Mohammed said.

When contacted, the General Manager of Badeggi Radio, Aisha Shuaibu, said they did not make any request to the Niger State Government. She explained they were waiting to see what the government would offer.

“That’s what I said. We didn’t request anything yet.

“We were waiting to hear what they will offer first,” she said.

It had earlier been reported that Bago ordered the closure of Badeggi Radio 90.1 FM in Minna and revoked its licence, accusing the station of incitement.

He instructed the Commissioner of Homeland Security, Mohammed Bello, and the Commissioner of Police, Adamu Elleman, to keep the station sealed.

Security operatives were also directed to profile the station’s owner, with the government alleging that the platform had been promoting violence.
