AMCON Act Cannot Override The Power of The Court to Grant Injunction – Lagos High Court

The High Court of Lagos State, Nigeria has ruled that the provisions of Section 34(6) of the AMCON (Amendment No. 2) Act, signed into law last August, is incapable of overriding the constitutional powers of the court to grant an injunction in relevant and deserving cases.

The court, through the Hon. Justice Kudirat Jose, made this determination on October 24, 2019 in respect of an application brought before it by Mr. Adedayo Mumuni Shittu, through his counsel Mayowa Owolabi (of Pistis Partners LLP).

Mr. Shittu had approached the court for an order restraining one Mr. Lanre Olaoluwa from preventing his (Shittu’s) access into his Victoria Park Estate home in the upscale Lekki district of Lagos, which he said he had bought, developed and occupied with his family before allegedly being forcibly evicted by the said Mr. Olaoluwa, ostensibly in compliance with a judgment against the parties who had initially sold the property to Mr. Shittu.

Ruling that its powers could not be curtailed by an Act of the National Assembly, Hon. Justice Jose was responding to an application by the Asset Management Corporation of Nigeria (AMCON) which sought to be joined in the suit, to the effect that by virtue of its powers under the above Act, no court in the country had the right to grant an injunction against the Corporation.

The judge, in granting the injunction, was emphatic about the unconstitutionality of the provisions of the Act, saying nothing in it was capable of curtailing the powers and sanctions of the court, which extends to all persons, authorities and entities – including, of course, AMCON.

Further hearing on the matter has been fixed for November 6, 2019.
