JUSUN to FG: Pay Funds Directly to State Judiciaries

The Judiciary Staff Union of Nigeria (JUSUN) has urged the federal government to order the federation’s attorney-general to pay state judiciaries directly.

On May 22, 2020, President Buhari signed into law Executive Order 10 requiring all states to make allocations for both the legislature and the judiciary in the first-line charge of their budgets.

For states that fail to allow judicial autonomy, the order directs the federation’s accountant-general to subtract the number from each state’s monthly allowance.
Speaking in an interview with NAN, Emmanuel Abioye, JUSUN deputy president, said the federal government should go ahead with paying the funds directly to heads of courts in states, instead of through the governors.

“We urge the president to exercise his powers under executive order 10 by directing the federation’s accountant-general to subtract at source all funds owed to state judiciaries and to pay the same directly to the heads of courts in states that have failed to comply with the executive order 10, as constitutional orders are non-negotiable,” he stated.

“In this case, my request to the federal government is that the order be issued to the public officer who is supposed to carry out the task.

“And who is this individual?
It is the federal accountant-general, perhaps by the federation’s attorney-general.

“In both of these cases, we don’t really need the governors’ approval until we do what needs to be done.”

Abioye expressed disappointment that the legislation has yet to be enforced after the union’s victory in the federal high court.

“What is needed is that the federation’s accountant-general, in accordance with the AGF’s directive, subtract the money from the source,” he said.

The union had gone on a national strike on April 6 to condemn the lack of financial autonomy for the judiciary.
