Court restrains Abia ex-commissioner from commenting on Gov. Otti

A High Court of the Federal Capital Territory (FCT) has granted an interlocutory injunction restraining a former Abia State Commissioner for Information, Barr. Eze Chikamnayo, from making or publishing comments concerning Abia State Governor, Alex Chioma Otti, pending the determination of a suit before the court.

Justice J.E. Obanor, in a ruling delivered on Thursday, ordered the defendant to refrain from writing, authoring, sharing, circulating, broadcasting, or otherwise disseminating content relating to the claimant on his Facebook page, Iyierioba Chikamnayo, or on any other social media or traditional media platforms, pending the determination of the substantive suit.

In the ruling, the judge said the court was satisfied that the application before it met the requirements for the grant of the interlocutory relief sought.

“Having carefully considered the application and all the processes before the Court, and there being no process challenging same, I am satisfied as to the need to grant the interlocutory order sought,” the judge held.

The matter was adjourned to January 19, 2026, for hearing.

The order followed a motion on notice filed by the governor’s legal team, led by Dr Sonny Ajala, SAN, seeking interim reliefs pending the resolution of the substantive suit.

According to court filings, the application was brought on the grounds that issues raised in the main suit were still before the court and required preservation of the status quo.

In an affidavit in support of the motion, sworn to by Ifeanyi Michael Agbo, a practice manager at Deeplaw Associates, the claimant’s legal team informed the court of the need to prevent actions capable of prejudicing the ongoing proceedings.

In a written address, counsel to the claimant argued that continued public commentary on issues connected to the suit could amount to interference with the judicial process, citing the principle of sub judice.

The substantive suit was filed in October 2025 and remains pending before the court.

Earlier, the court had granted leave to serve court processes on the defendant through substituted means after being informed of the channels through which service could be effected.

The defendant was directed to enter an appearance within the time stipulated by law.
