Court dismisses suit seeking to stop EFCC probe in Bauchi

A Bauchi State High Court has dismissed a suit filed by Alhaji Hamza Koshe and his company, Pentech Engineering Nig. Ltd, seeking to stop the Economic and Financial Crimes Commission (EFCC) from investigating and prosecuting them.

Justice Aliyu Baba Usman, in a ruling delivered on July 30, 2025, held that courts lack the powers to issue perpetual injunctions restraining law enforcement agencies from carrying out their constitutional duties.

“The court cannot, by perpetual order or any other means, stop the EFCC or ICPC from performing their legitimate functions of investigation and prosecution of money laundering, corruption, economic and financial crimes, or other related offences,” Justice Usman declared.

Koshe had approached the court on September 23, 2024, with a 31-paragraph affidavit, asking for an order to prevent the EFCC, ICPC, or any of their agents from investigating matters related to a contract financing agreement between the Bauchi State Ministry of Finance (Treasury Division) and his company.

Instead of honouring an earlier EFCC invitation for questioning, Koshe filed the suit to halt the probe. The ruling, however, clears the way for the EFCC to proceed with its investigation.
