The Court of Appeal sitting in Abuja recently delivered a unanimous judgment affirming the nomination of Asue Ighodalo as the governorship candidate of the Peoples Democratic Party (PDP) in Edo state. The judgment, delivered by Justice A. M. Lamido in the suit marked CA/ABJ/CV/642/2024, dismissed an appeal brought by former deputy governor, Philip Shaibu.
Shaibu had challenged the earlier judgment of Justice James Omotosho of the Federal High Court in Abuja, which had declared Dr. Asue Ighodalo as the rightful and duly nominated candidate of the PDP in Edo state. The Court of Appeal upheld the trial court’s ruling, stating that Shaibu did not meet the necessary conditions before instituting the action, making the suit premature.
Furthermore, the Appellate Court affirmed the trial court’s decision that Shaibu failed to provide evidence to support his allegations of vote allocation against the Respondent. The court emphasized that election conduct and results are presumed regular unless proven otherwise. Shaibu’s affidavit did not demonstrate that votes were allocated to the 4th Respondent.
As a result, the court dismissed Philip Shaibu’s case and awarded a cost of 1,000,000 Naira against him in favor of the respective Respondents. This decision comes after a Federal High Court in Abuja had also affirmed Ighodalo as the PDP governorship candidate in the upcoming September 21st gubernatorial election in Edo State.
