The Lagos Judicial Division of the National Industrial Court, under the leadership of Hon. Justice Maureen Esowe, has invalidated the alleged dismissal of Dr. Hemeson Edwin from the Civil Defence, Correctional, Fire And Immigration Services Board. Justice Esowe emphasized that the charges leading to Dr. Edwin’s suspension differed from those in the query, indicating a violation of Public Service Rules.
The Court has directed Dr. Edwin’s reinstatement, along with full entitlements from the date of his suspension on November 29, 2019. Dr. Edwin, a medical doctor employed by the Board since December 18, 2001, asserted that the disciplinary process and subsequent dismissal did not adhere to Public Service Rules.
While the Civil Defence, Correctional, Fire And Immigration Services Board sought dismissal on grounds of incompetence and statute bar, the Court dismissed claims against the Controller General, Nigeria Correctional Services, citing statutory limitations. Justice Esowe affirmed that Dr. Edwin’s case against the Board falls within exceptions to the Public Officers Protection Act, emphasizing the lack of a substantial case against him and unsubstantiated allegations in the suspension letter.
The Court declared the suspension and dismissal of Dr. Edwin as null and void, citing a denial of fair hearing and ruling that the Board failed to establish a serious prima facie case.
