DISTINGUISHED SENATOR BULKACHUWA AND THE LEGISLATIVE PRIVILEGE

The voluntary confession of Distinguished Senator BULKACHUWA in the floor of the National Assembly at their valedictory session has generated so much concerned by Nigerians, especially lovers of Justice and due process.

I’ve also read people’s worries and concerned from the tabloids and in the internet concerning an elder state’s man who should have known better.The Senator voluntary confession did not only rubbish the wife, Hon. Justice Bulkachuwa’ forty (40) years of her excellent career in the judicial circle but the whole judicial system in our beloved country.

This act of irresponsibility should be deprecated by all Nigerians.Interestingly, the wife, Hon. Justice Bulkachuwa (rtd) had come out clean, denying the said allegations against her by the lovely husband, Distinguished Senator BULKACHUWA. As a matter of fact, they have a lot to settle in the other room. Only God knows who will meditate for them.

After going through the voluntary confession by the Senator and the denial by the wife, Hon Justice Bulkachuwa, one thing is clear and that is, certainly one of them is lying to Nigerians. To be honest, I don’t know who is telling Nigerians the truth. It could be either of them. Your guess is as good as mine.There is a general conclusion within the legal profession and outside the profession that the quality of adjudication by Nigeria courts has declined in the past twenty years hence the condemnation by all and sundry.

This condemnation could be the reason why the leader of the bar, NBA President, Maikyau (SAN) was compelled to write law enforcement agencies to interrogate the Distinguished Senator.My worries are that can the Distinguished Senator be subjected to any form of interrogation by the security agencies for what he said in the floor of the Senate?

It is our law that whatever he said in the floor of the Senate, even if he said he robbed a bank cannot be used against him, his wife or anybody because he was then covered with the toga of legislative privileges.This is also applicable to our legal profession.A judge or magistrate cannot be sued in matter done in his judicial capacity no matter how punitive or malicious or dishonest his action may be even if such an action is actuated by corruption, bias or mistake.

The reason for this judicial immunity is not because the judge or magistrate has judicial privilege to make mistakes or to do wrongs, but to enable him do his work or duty without any inhibition and free from fear. This privilege is also extended to barristers.However, one thing is clear even though he is covered with the toga of legislative privilege, as a nation we have known the type of justice his wife was compelled to deliver to Nigerians because of his overbearing influence. He has succeeded in rubbishing the wife hard labour for 40 years.

The lesson here is that married woman who are judges and Magistrates should be careful of their husband over being influenced on the judgement they deliver.We are watchingSabastine U Anyia Esq
