The chairperson of the Section on Legal Practice of the Nigerian Bar Association (SLP NBA), Mrs. Miannaya Essien, SAN, CIArb, and the Chairman of the Democratic Process and Electoral Litigation Committee, Chief Ferdinand Orbih, SAN wish to invite all legal practitioners, politicians, policy makers, government officials and other stakeholders to a one-day conference on Electoral Process scheduled on Monday 3rd of December, 2018 themed “The Role of Litigation in the 2019 Nigerian Electoral Process”, at the NBA Port Harcourt Branch House, Port Harcourt, Rivers State.

In a narrow sense, what role are lawyers and the courts playing in the process of intervening in electoral disputes?

More broadly, how is the involvement of litigants in those disputes influencing the broader democratisation process?

After examining relevant data from Nigeria’s elections since 1999, it indicates that out of hundreds of disputed gubernatorial election results, only 5.3% success were recorded in court.

Proper investigation arrived at two conclusions: 1. Courts in Nigeria are failing to adequately address electoral disputes because the legal burden of proof required of petitioners is too demanding to be effective.  2.  The perceived inaction of courts enable incumbents to consistently retain power, thereby negating the principle of consolidation of democracy.

The conference which is being held a few months before the 2019 elections is being held at the best of times and will challenge all stakeholders to review the Democratic process and Electoral Litigation challenges.
