Obey the Court Order and Stop Intimidating the Court, Ubani Urges DSS
The immediate past 2nd Vice President of NBA Monday Onyekachi Ubani, popularly known as MOU has registered his displeasure over the news making rounds that DSS has refused to release Mr Sowore Omoleye, the Convener of #RevolutionNow.
More worrisome to him is the threat of the Agency to report Justice Taiwo Taiwo, the federal high court judge handling the matter to National Judicial Council for granting an order for the release of Mr Sowore after the expiration of the 45 days detention order earlier granted by the same court.
Mr. Ubani said that he is clearly at a loss as how and when court’s decision has become a ground for petitioning NJC. “What is the allegation against Justice Taiwo Taiwo in the first place? Is it that he has no jurisdiction to release Mr. Sowore after the expiration of the detention order or that the court has lost all the powers under the law to make orders that does not favour DSS in Nigeria anymore? I cannot understand the meaning and substance of the alleged threat to petition him to NJC” he wondered.
Mr. Ubani advised DSS that should they go ahead with the said petition, they must also not forget to report to NJC that it was the same Justice Taiwo Taiwo that granted them the detention of Mr Sowore for 45 days in their detention centre. That information to him is very important to be disclosed to NJC.
“It is high time lawyers stood up against this calamitous destruction of the legal system by the security agencies in Nigeria. We lawyers cannot keep quiet anymore because they are trying to destroy the only area where we are operating, which is the court.
“Judiciary is the only place where we operate, so if they succeed in destroying it no one will have regard and respect for us and for the country.
“If lawyers allow the Judiciary to be emasculated by the executive we are finished, Nigeria is gone, the Legal profession is finished. He therefore advised that all men and women of conscience should stand up and urge the Nigerian leaders to respect court orders and not to destroy the judicial system in the country. If we no longer want the judicial arm of government, the constitution should be duly amended to that effect and everyone will know that Nigeria has no judiciary anymore”.
Ubani still believe that the story of reporting the judge to NJC cannot possibly be true, but a figment of the imagination of the reporter. He also believe that even if DSS desires to appeal against the decision of Justice Taiwo Taiwo, they will obey the court order first as they cannot appeal whilst remaining in contempt of the court order. On the issue of service of the order of the court he further advised the legal team of Mr Sowore to bring application for substituted service quickly to put a lie to this developing drama. Now that the president is back to the country, he believes that proper instruction will be issued by him to the DG of DSS to save Nigeria from this embarrassing episode, especially after coming back from a UN event where he the president promised the world that Nigeria will observe rule of law including obedience to court orders.
