Group Sues Akpabio, Others Over Formation of Interim Management Board for NDDC

A group of lawyers, activists and stakeholders has dragged the Minister of the Federal Ministry of Niger Delta Affairs, Sen. Goodswill Akpabio and other senior members of the ministry before the Federal High Court in Abuja, over what the group called the ‘unlawful’ appointment of a three-man interim management committee.

Briefing members of the press on its reasons for the public interest suit, the group’s arrowhead and Coordinator of Legal Defense Assistance Project, Dr. Chino Obiagwu, SAN, insisted that the Minister lacked the powers to set up such a committee, there was no provision in the NDDC Act for such a body. Only the President, he added, had the powers to take such an action, and even then it was subject to confirmation by the National Assembly.

He described the Minister’s action as a purely political move designed to prejudice and thwart the aims of the imminent forensic audit of the NDDC as announced by President Muhammadu Buhari, which has received the backing of the National Assembly.

Obiagwu identified two ‘red flags’ in the Minister’s action: one, the fact that the committee was formed at a time when the Senate was still screening the nominees for the substantive NDDC board. The second red flag was the fact that there was no stated time-frame in the committee’s terms of reference (despite its ‘interim’ nature). The unspoken aim of the committee, he alleged, was to usurp the functions of NDDC board.

Joined in the suit along with Sen. Akpabio are the following: Sen. Godswill Akpabio; the NDDC; Dr. Gbene Joi Nunieh; Dr. Cairo Ojougboh; and Chief Ibanga Bassey Etang, all of the N/Delta Affairs Ministry.

The plaintiffs were identified as follows: Iruo Onoruvwe; Anatole Osuji; Walter Abere; and the Legal Assistance and Protection Limited.
