Vacate Contempt Proceedings, INEC Urges Kano Tribunal
The Independent National Electoral Commission (INEC) has urged the Governorship Election Petition Tribunal to set aside the contempt proceedings filed by the People’s Democratic Party (PDP) against its Resident Electoral Commissioner in Kano, Riskuwa Arabu Shehu.
PDP had filed forms 48 and 49, seeking the court to prosecute Riskuwa for allegedly disobeying the court order to grant the petitioners access to inspect and photocopy election materials used during March 23 Governorship election.
The Counsel to INEC, Barr. Adedayo Adedeji, urged the court to dismiss the application filed by the petitioners lacks merit and incompetent.
Adedeji filed a motion to set aside the contempt proceedings that was initiated by the petitioners and also filed a preliminary objection urging the court to strike out the petitions.
Counsel to Ganduje, Aliyu Umar SAN, also urged the court to strike out the petition for lack of merit.
The Counsel to the petitioners, Adebayo Owomolo, made an application for withdrawal of two applications of the five motions filed before the tribunal.
He said the withdrawal was based on some parts of the paragraphs the All Progressive Congress response were challenging the petitioners.
Justice Halima Shamaki Mohammed announced the adoption of all petition and counter affidavit filed by the petitioners and the defendants.
Mohammed therefore adjourned the case until July 13, for continuation of hearing.
