Nairobi 2018: African Bar Association Calls for Prompt Registration Ahead of Conference

The African Bar Association, (AFBA) is pleased once again to announce its 2018 conference with the theme: “Africa’s Socio-Economic and Political Future: African Union’s Agenda 2063 in perspective.”
The African Bar Association, AFBA, was established in 1971 as a Professional body uniting individual lawyers and national legal associations in Africa.
The Association seeks amongst other objectives to foster exchange of opinions and experiences among members, formulation of policies that would better reposition the continent’s socio-economic and political development and advancement with the law as the bedrock for these developments. AFBA encourages its members to break into new legal frontiers. The Association seeks to bring together lawyers and Bar Associations in and outside Africa.
THEME
The 2018 AFBA conference will review the African Union’s Agenda 2063 with a view to assessing how ready the continent is to achieve the set objectives in the light of extant laws and policy and contributing to shaping the Agenda for a true African Economic, Political and Social Prosperity based on Constitutional Democracy and the Rule of Law.
The African Union’s Agenda 2063 is premised on certain aspirations and we encourage papers that not only review the Agenda on the basis of these aspirations but also test the integrity of the aspirations themselves and provide solutions and give guidance on their achievement within the context of the Rule of Law.
Nairobi 2018 would be addressing the following areas:
- African Business Roundtable: -The Investment that Africa needs: This will deal with the impact of modern slavery on investment in Africa; Africans investing in Africa; and the availability of indigenous finance.
- African Integration: -The Political Unity and Economic Integration of Africa: It would bring to reality the wishes, visions and the reality of political unity and equal business/economic access for all African. This is a process of opening up our borders, communities and organization to all Africans, regardless of race, religion, ethnicity, gender, or social class.
The fact is, how can law facilitate the political unity of Africa? We need to learn from similar experiments, the EU for example.
- Human Rights: The African Human Rights System As A Tool For Achieving Agenda 2063 Aspirations.

- Trade: Implications of Mobilizing African Resources for Development Through Trade
This important topic is created for harmonizing of trade laws to enhance intra African trade: The case for the expansion and review of OHADA within the African Union 2063 Agenda. OHADA is a system of business laws and implementing institutions adopted by sixteen West and Central African nations. OHADA is the French acronym for “Organisation pour l’Harmonisation en Afrique du Droit des Affaires”, which translates into English as “Organisation for the Harmonization of Business Law in Africa”. It was created on October 17, 1993 in Port Louis, Mauritius.
The OHADA Treaty is made up today of 16 Africans states. Initially fourteen African countries signed the treaty, with two countries (Comoros and Guinea) subsequently adhering to the treaty and a third (the Democratic Republic of Congo) due to adhere shortly. The Treaty is open to all states, whether or not members of the Organisation of African Unity.

The focus of the session would be: (a) Project Finance/ Infrastructure Development: Developing A Sustainable Framework for Infrastructure Development and Indigenous Finance (b) Women Lawyer Interest Forum: Considerations for Women and Children
In Agenda 2063; Sub themes: What knowledge & skills do they require? What roles can they play? How can they take advantage of the opportunities and surmount the challenge of Agenda 2063?
- Mining & Extractive Industry law: Use of the Mining and Extractive Industry Resources for Development, Strategy, Know-How, Law and Policy in Africa.
- Environmental Law & Climate change: Is Africa’s legal regime for its environment and climate fit for purpose?
- Sports and Entertainment Law: The Law and Policy of Developing African Talents
In Africa; Sub theme would be the Proposal to form a working group to explore the possibilities of drafting a framework for model rules to govern sports in Africa Contracting/negotiations/ franchising etc.
- Customary Law: African Customary Law as A Catalyst for its Development
- Taxation: Financing Agenda 2063 – Tax as an option; Sub themes:- Double taxation treaties by African countries ; Taxation subject to local circumstances.
- Stability& Security: Legal Solutions to threats to Agenda 2063-Terrorism, Corruption, Wars &Money Laundry
- Health law: Developments in Public Health Law in Africa
- Intellectual Property: Protection Of Intellectual Property and Pan-Africanism: Is Africa Ready for a common IP framework?
