Reps Vote Against a Bill That Would Restrict The Number of Cases Handled by the Supreme Court.

On Thursday, a bill aimed at reducing the number of appeals that reach the Supreme Court was opposed in the House of Representatives.

The bill was being debated for a second reading when it was rejected by the lawmakers.

The bill, titled “Constitution of the Federal Republic of Nigeria (Fifth Alteration) Bill, 2020,” aims to make all supreme court appeals go through leave, “that is, the court will decide if a specific case merits its attention by way of application.”

Onofiok Luke, a lawmaker from Akwa Ibom and the bill’s sponsor, said the supreme court is overburdened by a large number of cases during the plenary session on Thursday.

The constitution gives the supreme court unrestricted authority to handle all cases, according to Luke, who is the chairman of the house judiciary committee. This gives “litigants the unfettered right in most cases to approach the court on any question,” he said.
“Some litigants and lawyers have taken advantage of this loophole and filed a slew of unjust and meritless lawsuits and interlocutory applications before the court,” he said.

“It is in this vein that a constitutional amendment to restrict appeals to the Supreme Court is proposed.”

Any legislators who spoke during the discussion warned that the bill should be thoroughly scrutinized in committee.

Toby Okechukwu, the house’s deputy minority leader, said that while there is a need to improve efficiency in the administration of justice, other options should be explored to resolve the questions posed about the Supreme Court.

“It’s important to investigate it and see if there are any other options for dealing with the issue of the load in the Supreme Court without lord justices,” he said.
