NBA-SPIDEL Condemns Obaseki’s Refusal to Swear In Edo Judges

The Nigerian Bar Association Section on Public Interest and Development Law (NBA-SPIDEL) has decried Governor Godwin Obaseki’s refusal to swear in 8 judges recommended for appointment by the National Judicial Council (NJC) in Edo State.

In a statement on Monday, NBA-SPIDEL described Obaseki’s action as an abuse of office and breach of constitutional powers. The group demanded the immediate confirmation of the judicial officers’ appointments made since June 2023

According to SPIDEL, the governor’s duty to swear in judges is constitutional and not discretionary. The continued delay despite the NJC’s recommendation is an abuse of power and disregard for the constitution, the group noted.

Citing Section 271(2) of the constitution, SPIDEL said Obaseki’s failure to swear in the judges has impaired justice delivery in Edo State. It added that the few serving judges are overburdened while the newly appointed officers remain idle without pay.

SPIDEL called on Gov. Obaseki to act accordingly and perform his constitutional duty by swearing in the new judges so as not to cripple the justice system in Edo

The group said the scenario highlights the need to completely insulate the judiciary from executive control in the appointment process
