No sooner has the ExCo of the Ikeja Branch of the NBA embroiled itself in a Contempt proceedings before Hon. Justice Lawal-Akapo sitting in the Ikeja Division of the High Court of Lagos State in Suit No. ID/4747GCM/2021, the same ExCo officials are precariously treading on another Contempt charge before the Hon. Justice Allagoa of the Federal High Court, Ikoyi, Lagos in Suit No. FHC/L/CS/1708/2021
It is highly unusual that legal practitioners who are officers of the court would ignore those rules precluding parties before the court from foisting a fait accompli on the court over a matter which the court has been seised, it is utterly mind-blowing that elected officials of the NBA would be the ones to throw caution to the winds and deliberately continue to dabble into a matter of which an application for injunction has been filed and served on them.
Under the legal principle of status quo ante bellum, parties are meant to avoid taking further steps or self-help in a matter before the court or to cease same so that the court is not put in a situation of complete helplessness.
