HIV Court Case: Ogun Court Orders Woman Against Media Comments

A magistrate court in Ago-Iwoye, Ogun state, has ordered Mrs. Titilayo Emiabata, a woman infected with the Human Immunodeficiency Virus (Hiv) by her husband, to refrain from speaking to the media about her ongoing case.

The 30-year old Mrs. Emiabata reportedly discovered antiretroviral medications in the possession of her husband, Lt. Col.  Kazeem O. Emiabata, and subsequently found medical records indicating that he had been living with HIV for a long period of time without disclosing his status.

She subsequently learned from a medical examination that she was also infected with the virus.

In the ensuing confrontation, Mr. Emiabata angrily threw her out of her matrimonial home, and later Had her arrested for burglary when she returned retrieve her personal belongings. She was detained in police custody for four days before being charged with ten counts of housebreaking and stealing.

Commenting on the request raised by prosecuting counsel team to restrict Mrs. Emiabata from addressing the media, Senior Magistrate E. O. Idowu told the defendant and her counsel, Inibehe Effiong, not precipitate a media trial.

He gave the feuding couple until October 24 to return to court with their respective witnesses.

Meanwhile, a number of human rights groups have condemned the trial of Mrs. Emiabata, saying that she was arrested on bogus charges and was being persecuted for having the courage to stand up to her husband.
