The Federal High Court sitting in Warri on Wednesday the 28th if September, 2017 granted leave to a widow, Mrs. Esther Oladele to sue the Nigerian Army, Lt. Col. T. A. Yakubu and Sgt. Hassan Hassan for the unlawful death of her husband, Otunba Ajayi Oladele, a Warri based businessman.
Counsel to the Plaintiff, Mr. Kunle Edun stated that the Defendants unlawfully arrested the deceased in Warri and took him to the 4 Mechanised Brigade Headquarters in Benin city, on the allegation that he duped a non military personnel of N1.5m. It was discovered that the deceased businessman while in the custody of the Army personnel was beaten and had his spinal chord broken. Medical reports from the military hospital, Benin City and autopsy from the Central Hospital, Warri put the primary cause of death as ” multilateral spinal chord injuries”. Mr. Edun also stated that the soldiers brought Otunba Oladele back to Warri in a vegetable state and died few minutes after being rushed into the emergency ward of the Central Hospital, Warri.
The Plaintiff’s counsel further stated that the facts if this case formed part of a petition that was heard in Port Harcourt by the Presidential Panel on the Abuse of Human Rights by Military Personnel.
